INTRODUCTORY STATEMENT
This is a legal agreement between You and Site administration stating the terms that govern your use of Services offered via Website. By using the Website and Services, you agree to be bound by these Terms of Service. If you disagree with any statement of the document below or do not wish to be bound with these Terms of Service, please leave this Website now. Your agreement with our Terms of Service becomes effective immediately after the start of the use of this Website.
VIN.DOCTOR SERVICES DEFINITION
Vin.Doctor is an online service that provides informational reports about the history of the used vehicles. The Website provides vehicle history reports based on the Title and Brand data from the National Motor Vehicle Title Information System (MNVTIS) and other partner resources.
USER INFRASTRUCTURE REQUIREMENTS
Use of the Website Service requires Internet access (fees may apply), certain software (fees may apply), and may require obtaining updates or upgrades from time to time. Because use of the Services involves hardware, software, and Internet access, your ability to use the Services may be affected by the performance of these factors.
USERS RESPONSIBILITIES
By using our Services, you accept that you will follow our Rules defined below. Vin.Doctor website requires an account registration ("Account"). Account registrations are limited per unique individual person. Account transfer or assignment is generally not permitted unless agreed to in writing by Vin.Doctor. If you do not have an account, it will be automatically created for you when you purchase your first report. Users should have at least 18 years of age to use the service.
A single Account may be used by a single individual or legal entity. You may not transfer your Account to any third party without the prior written consent of Site Administration.
Site Administration has the right at any time for any reason or no reason to suspend or terminate your Account, terminate this Agreement, and/or refuse any and all current or future use of the Services without notice or liability to you.
Site Administration has the right to change pricing and services available at any time without prior notification to the Users of the Website.
Any and all payments for services shall be made by the Customer in United States dollars. In order to process your payment, we use Stripe, a third-party payment processor.
Service or Report Resell. Unless expressly authorized in writing by Vin.Doctor, you agree not to reproduce, duplicate, copy, sell, trade, resell, redistribute, or exploit for any commercial purposes any: (a) portion of the Services; (b) reports and other products received by you via the use of the Services, including Vin.Doctor’s response methods; or (c) access to the Services, including, but not limited to Account information.
Your use of the Services includes the ability to enter into agreements and/or to make transactions electronically. YOU ACKNOWLEDGE THAT YOUR INTERACTION WITH WEBSITE CONSTITUTE YOUR AGREEMENT AND INTENT TO BE BOUND BY THESE TERMS OF SERVICE AND PAY FOR THE SERVICE. YOUR AGREEMENT AND INTENT TO BE BOUND BY ELECTRONIC SUBMISSIONS APPLIES TO ALL RECORDS RELATING TO ALL TRANSACTIONS YOU ENTER INTO ON THIS SITE, INCLUDING NOTICES OF CANCELLATION, POLICIES, CONTRACTS, AND APPLICATIONS. In order to access and retain your electronic records, you may be required to have certain hardware and software, which are your sole responsibility.
INTELLECTUAL PROPERTY RIGHTS
You acknowledge that Vin.Doctor owns all rights, title and interest in and to the Services, including all intellectual property rights (the “Vin.Doctor Rights"). Vin.Doctor Rights are protected by U.S. and international intellectual property laws. With respect to these Terms of service you agree that you will not copy, reproduce, alter, modify, reverse-engineer or create derivative works from the Services or any part of the Vin.Doctor Website. You also agree that you will not use any robot, spider, other automated device, or manual process to monitor or copy any content from the Service.
Unless you have agreed otherwise in writing with Vin.Doctor, nothing in the Terms and Conditions gives you a right to use any of Vin.Doctor’s trade names, trademarks, service marks, logos, domain names, and other distinctive brand features. As described immediately below, Vin.Doctor rights do not include third-party content used as part of the Services, including the content of communications appearing on the Services. Vin.Doctor claims no ownership or control over any content submitted, posted or displayed by you on or through Vin.Doctor Services. You or a third-party licensor, as appropriate, retain all patent, trademark and copyright to any content you submit, post or display on or through Vin.Doctor Services and you are responsible for protecting those rights, as appropriate.
NMVTIS CONSUMER ACCESS DISCLAIMER
The National Motor Vehicle Title Information System (NMVTIS) is an electronic system that contains information on certain automobiles titled in the United States. NMVTIS is intended to serve as a reliable source of title and brand history for automobiles, but it does not contain detailed information regarding a vehicle's repair history.
All states, insurance companies, and junk and salvage yards are required by federal law to regularly report information to NMVTIS. However, NMVTIS does not contain information on all motor vehicles in the United States because some states are not yet providing their vehicle data to the system. Currently, the data provided to NMVTIS by states is provided in a variety of time frames; while some states report and update NMVTIS data in "real-time" (as title transactions occur), other states send updates less frequently, such as once every 24 hours or within a period of days.
Information on previous, significant vehicle damage may not be included in the system if the vehicle was never determined by an insurance company (or other appropriate entity) to be a "total loss" or branded by a state titling agency. Conversely, an insurance carrier may be required to report a "total loss" even if the vehicle's titling-state has not determined the vehicle to be "salvage" or "junk."
A vehicle history report is NOT a substitute for an independent vehicle inspection. Before making a decision to purchase a vehicle, consumers are strongly encouraged to also obtain an independent vehicle inspection to ensure the vehicle does not have hidden damage. The Approved NMVTIS Data Providers can include vehicle condition data from sources other than NMVTIS.
NMVTIS data includes (as available by those entities required to report to the System):
- Information from participating state motor vehicle titling agencies.
- Information on automobiles, buses, trucks, motorcycles, recreational vehicles, motor homes, and tractors.
MVTIS may not currently include commercial vehicles if those vehicles are not included in a state's primary database for title records (in some states, those vehicles are managed by a separate state agency), although these records may be added at a later time.
- Information on "brands" applied to vehicles provided by participating state motor vehicle titling agencies.
Brand types and definitions vary by state, but may provide useful information about the condition or prior use of the vehicle.
- Most recent odometer reading in the state's title record.
- Information from insurance companies, and auto recyclers, including junk and salvage yards, that is required by law to be reported to the system, beginning March 31, 2009. This information will include if the vehicle was determined to be a "total loss" by an insurance carrier.
- Information from junk and salvage yards receiving a "cash for clunker" vehicle traded-in under the Consumer Assistance to Recycle and Save Act of 2009 (CARS) Program.
Consumers are advised to visit www.vehiclehistory.gov for details on how to interpret the information in the system and understand the meaning of various labels applied to vehicles by the participating state motor vehicle titling agencies.
VIN.DOCTOR DISCLAIMER
The information used to compile Vin.Doctor report is aggregated from various government agencies, non-profit organizations, and industry sources. Access to the National Motor Vehicle Title Information System (NMVTIS) is facilitated through VinAudit Inc., an Approved NMVTIS Data Provider.
The accuracy and reliability of the information supplied depends primarily on the reporting sources, and all entities involved in compiling this report accept no liability for any errors or omissions. Furthermore, all warranties, expressed or implied, including any implied warranties of merchantability or fitness for a particular purpose are hereby disclaimed.
SERVICE QUALITY DISCLAIMER
This part of the document defined the level of quality you should be expecting from the Vin.Doctor website:
- SERVICE LEVEL. It is our key priority to provide you the best services possible. Though since our services are dependent on the technical infrastructure of our Service, technical characteristics of Users’ hardware and Internet connection, we ask you to understand that Vin.Doctor provides no guarantee that the Services will always function without disruptions, delay, or other imperfections.
- SOFTWARE CHANGES AND TECHNICAL IMPROVEMENTS. We may change technical features in order to provide you better service, be compliant with the latest technology trends and regulatory requirements. Vin.Doctor may also have to repair, improve, and/or upgrade the Services and this may demand restriction, limitation, suspension or other interruption of our Service.
- DATA STORAGE. With accepting these Terms of Service You agree that Vin.Doctor has no responsibility or liability for the deletion of, or the failure to store or to transmit, any content and other communications maintained by the Services. Vin.Doctor retains the right to create limits on use and storage at our sole discretion at any time with or without notice.
- CONTENT RESPONSIBILITY. Vin.Doctor takes no responsibility for third-party content.
- ACCOUNT AND SERVICE TERMINATION. Vin.Doctor reserves the right to change pricing policy, and/or these Terms of Service. We may suspend or terminate the Service to you if we find that you are not complying with our Terms of service and/or our Privacy policy. Site administration may discontinue the Services of Vin.Doctor at any time.
THIRD-PARTY MATERIALS OR WEBSITES DISCLAIMER
Certain content, products, and data available via the Services may include materials from third parties. In addition, Vin.Doctor may provide links to certain third-party Web sites. You acknowledge and agree that Vin.Doctor is not responsible for examining or evaluating the content or accuracy of any such third-party material or Web sites. Links to other Web sites are provided solely as a convenience to you. You agree that you will not use any third-party materials in a manner that would infringe or violate the rights of any other party and that Vin.Doctor is not in any way responsible for any such use by you.
DISCLAIMER OF WARRANTIES; LIABILITY LIMITATIONS
Vin.Doctor is provided to our users AS IS and AS AVAILABLE, without warranties of any kind, either express or implied. In no event shall Vin.Doctor and\or Site Administration be liable for any direct, special, indirect, incidental, special, exemplary, consequential damages or any other damages including but not limited to, loss of use, loss of profits, loss of data.
LEGAL COMPLIANCE
Vin.Doctor website is operated by the US company registered in Florida. You agree to comply with all local, state, federal, and national laws, statutes, ordinances, and regulations that apply to your use of the Service.
TERMINATION
Account termination
If you fail, or Site Administration suspects that you have failed, to comply with any of the provisions of this Agreement, including but not limited to failure to make payment of fees due, failure to safeguard your account information, violation of the Vin.Doctor Terms of service or any license, or infringement or other violation of third parties' rights, Vin.Doctor, at its sole discretion, without notice to you may:
- terminate this Agreement and/or your account, and you will remain liable for all amounts due under your account up to and including the date of termination; and/or
- terminate the license to the software; and/or
- preclude access to the Services (or any part thereof).
Services Termination
Site Administration reserves the right to modify, suspend, or discontinue the Services (or any part or content thereof) at any time with or without notice to you, and Site Administration will not be liable to you or to any third party should it exercise such rights.
MISCELLANEOUS
These Terms of Service constitute the entire agreement between you and Vin.Doctor and govern your use of the Service, superseding any prior agreements between you and Vin.Doctor. You also may be subject to additional terms and conditions that may apply when you use affiliate services, third-party content, or third-party software. If any part of these Terms of Service is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining portions shall remain in full force and effect. Vin.Doctor’s failure to enforce any right or provisions in these Terms of Service will not constitute a waiver of such provision or any other provision of these Terms of Service. Site Administration will not be responsible for failures to fulfill any obligations due to causes beyond its control.
